The right of this line of Scrymgeours to the Earldom of Dundee (and Viscounts Dudhope) was not formally accepted by the Committee of Privileges of the House of Lords until July 1952 when John's descendant Henry James Scrymgeour-Wedderburn became accepted as 11th Earl of Dundee. Arguably the main reason for the delay for such recognition arose from the influence of John Maitland, Duke of Lauderdale, who claimed the right to be Scotland's hereditary standard bearer.
